Our Public Procurement team advises tenderers and contracting authorities on all aspects related to the procedure for the award of public works contracts, supply contracts and service contracts financed by national and European funds, as well as on the applicable EU and Romanian legal framework.

The team also advise tenderers and contracting authorities on the negotiation and conclusion of FIDIC Red/ Yellow contracts.

The team’s areas of specialization include:

• Advice on various issues concerning the award documentation, clarifications’ requests, activities/ minutes of the evaluation commission, tenders submitted negotiation/conclusion of public contracts.

• Representation of contracting authorities and tenderers before the National Challenge Settlement Council and courts.

MAJOR PROJECTS

Legal assistance provided to:

1. Tenderer in the procedure for the award of a public works contract regarding a transport infrastructure project financed from European funds, in estimated value of approximately € 117,000,000 and also in the negotiation of the public contract.
2. Tenderer in the procedure for the award of a public works contract regarding an environmental protection project financed from European funds, SOP Transport and SOP Environment, in estimated value between € 104,000,000 and € 114,000,000 and also in the negotiation of the public contract.
3. Contracting authority in the negotiation of a public contract for the acquisition of IT services in approximate value of € 22,000,000.
4. Contracting authority in the procedure for the award of a public service contract in four major projects financed by European funds, in total value of over € 10,000,000, including legal expertise in the projects’ management team. 
5. Contracting authority in a project financed by European funds regarding social reintegration of prisoners.
6. Contracting authority in a project financed by European funds regarding human resources development in education.
7. Tenderer in preparation of the tender offer for a public service contract for an advertising campaign through pan European and international television channels, as well as also in the negotiations of the contract.
8. Ministry of Finances for a project regarding the implementation into Romanian legislation of EU frame-contracts for public works, supply and services.
9. Contracting authority for the award of public service contract for the acquisition of IT services in value of € 20,000,000 as well as in the negotiation of the contract.
